FBI agent Eduardo Valdivia, 40, faces charges of rape and assault involving two women in Maryland, according to Montgomery County police. These charges come nearly two years after a Maryland jury acquitted him of attempted murder for shooting and wounding a passenger on a Washington, DC-area Metro train in 2020.

Valdivia is accused of contacting two women, both in their 20s, through an Instagram page under a false identity, offering tattoos and help with modeling opportunities. Unaware he was an FBI agent, the women visited Valdivia’s unlicensed tattoo shop in Gaithersburg. One woman was offered a free tattoo in exchange for modeling, and after completing the tattoo, Valdivia allegedly coerced her into a second meeting for a photoshoot at a hotel, where she was sexually assaulted. The second victim met Valdivia under similar circumstances and was also assaulted during a photoshoot.

Valdivia was arrested on Monday and charged with 10 felonies and misdemeanors, including second-degree rape and assault. His defense attorney, Robert Bonsib, disputed the allegations, stating that the defense would await all evidence before commenting further. Valdivia remains in custody without bond, and his next court appearance is scheduled for December 20. The FBI has suspended him pending investigation.
